1. Acceptance of Terms

By accessing or using Clixor ("the Platform", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

1.1 Eligibility

• You must be at least 18 years old to use this Platform
• You must be legally permitted to participate in skill-based gaming in your jurisdiction
• You represent that all information provided is accurate and complete
• You are responsible for compliance with local laws regarding online gaming

1.2 Account Registration

• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account
• You must notify us immediately of any unauthorized access
• One account per person; multiple accounts are prohibited

2. Platform Description

2.1 Service Overview

Clixor is a skill-based gaming platform where users compete in tournaments for cash prizes. Games include:

• Tap Sprint (precision tapping challenge)
• Trivia (knowledge-based quiz game)
• Math (speed arithmetic challenge)
• Sudoku (classic logic puzzle with multiple difficulty levels)
• Rainbow Rush (match-3 puzzle game)
• Reaction (reflex and reaction time test)

2.2 Skill-Based Gaming

• All games are skill-based, not games of chance
• Outcomes are determined by player skill, not random chance
• No gambling or betting on uncertain outcomes

3. Financial Terms

3.1 Entry Fees and Prizes

• Users pay entry fees to participate in tournaments
• Prize pools are distributed to winners based on performance
• Platform retains 20% of gross entry fees as service fee
• Winners receive 80% of gross entry fees (split equally in case of ties)

3.2 Payment Processing

• All transactions are processed in US Dollars (USD)
• Deposits are made via PayPal through our secure website
• Minimum deposit: $1.00
• Deposits are handled on https://omarela.com/clixor/deposit

3.3 Withdrawals

• Minimum withdrawal: $5.00
• Withdrawals processed via PayPal through our secure website
• Processing time: 1-3 business days
• KYC verification required for all deposits and withdrawals
• Withdrawals are handled on https://omarela.com/clixor/withdraw
• Bonus funds cannot be withdrawn until wagering requirements are met

3.4 Fees

• Platform fee: 20% of tournament entry fees
• No deposit fees (PayPal may charge standard processing fees)
• No withdrawal fees (PayPal may charge standard processing fees)
• All transactions in USD

4. Bonus and Promotional Terms

4.1 Referral Bonuses

• Referral bonuses are credited as "Bonus Funds" (non-withdrawable)
• Both referrer and referee receive $5 when referee deposits $10 or more
• Only one referral code can be applied per account
• Referral codes must be entered during registration
• Referral codes cannot be changed after registration

4.2 Bonus Wagering Requirements

• All bonus funds must be wagered 3x (three times) in tournaments before withdrawal
• Example: $5 bonus requires $15 in tournament entry fees
• Bonus funds are automatically used for tournament entries before real money
• Wagering progress is tracked automatically
• Partial wagering does not unlock partial bonus amounts

4.3 Bonus Fund Usage

• Bonus funds cannot be withdrawn directly
• Bonus funds are used before real money for tournament entries
• Winnings from bonus-funded tournaments are added to withdrawable balance
• Unused bonus funds remain in account until wagered or forfeited
• Bonus funds expire after 90 days of inactivity

4.4 Bonus Restrictions

• Bonus funds cannot be transferred between users
• Bonus abuse (multiple accounts, fraud) results in immediate forfeiture
• Platform reserves right to void bonuses in case of abuse or violation
• Maximum bonus balance per account: $100
• Bonuses are non-transferable and have no cash value

5. Know Your Customer (KYC) Requirements

5.1 Verification Requirements

• Identity verification required for all deposits and withdrawals
• Verification provided by Sumsub (third-party KYC provider)
• Required documents: Government-issued ID and selfie verification
• Verification typically completed within 24-48 hours
• Must verify identity before making first deposit or withdrawal

5.2 Anti-Money Laundering (AML)

• We comply with EU AML directives and international standards
• Suspicious activity will be reported to relevant authorities
• Accounts may be frozen pending investigation
• We reserve the right to request additional documentation

5.3 Restricted Jurisdictions

Users from the following jurisdictions are prohibited:

• Countries under international sanctions
• Jurisdictions where skill-based gaming is illegal
• Users must verify their location is permitted

6. User Conduct and Prohibited Activities

6.1 Prohibited Activities

You agree NOT to:

• Use multiple accounts or share accounts
• Engage in collusion or cheating
• Use bots, scripts, or automated tools
• Exploit bugs or glitches for unfair advantage
• Harass, threaten, or abuse other users
• Engage in money laundering or fraud
• Reverse engineer or decompile the Platform
• Use VPNs to circumvent geographic restrictions

6.2 Fair Play

• All users must compete fairly and honestly
• Cheating, hacking, or exploiting will result in immediate ban
• We use anti-cheat measures and may review gameplay
• Suspicious activity will be investigated

6.3 Account Suspension and Termination

We reserve the right to:

• Suspend or terminate accounts for violations
• Withhold funds pending investigation
• Report illegal activity to authorities
• Refuse service to any user at our discretion

7. Intellectual Property

7.1 Platform Ownership

• All content, features, and functionality are owned by Omarela
• Platform code, design, graphics, and trademarks are protected by copyright
• You may not copy, modify, or distribute any Platform content
• Unauthorized use may result in legal action

7.2 User Content

• You retain ownership of any content you submit
• By submitting content, you grant us a license to use, display, and distribute it
• You represent that you have rights to all submitted content

8. Privacy and Data Protection

8.1 GDPR Compliance

• We comply with EU General Data Protection Regulation (GDPR)

9. Disclaimers and Warranties

9.1 Platform "As Is"

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Guarantee of Winnings

• We do not guarantee any winnings or prizes
• Outcomes depend entirely on player skill
• Past performance does not guarantee future results
• You may lose money playing on the Platform

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMARELA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10.1 Maximum Liability

Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim, or €100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Omarela, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your violation of these Terms
• Your violation of any law or rights of third parties
• Your use of the Platform
• Your content or submissions

12. Dispute Resolution

12.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at legal@omarela.com to attempt to resolve the issue informally. We will work in good faith to resolve disputes within 30 days.

12.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the Netherlands Arbitration Institute (NAI).

12.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and Omarela individually. You waive any right to participate in a class action lawsuit.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of Rotterdam, the Netherlands.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

We will notify users of material changes via email or Platform notification at least 30 days before the effective date.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
